General Conditions of Sale for online purchases on www.colma.it

Colma srl, with registered office in Tolentino (MC) – Italy, Viale della Concordia 1, VAT no. 01178470439 (hereinafter “Colma”) makes available to all users the possibility of purchasing its products through the website www.colma.it (hereinafter “Site”), which is under Colma’s exclusive ownership.

The entire process of the purchase order fulfillment (preparation, shipment of goods and billing) is instead owned by the company Carenamed srls, with registered office in Tolentino (MC) – Italy, Contrada Colmaggiore 7, VAT No. 01961130430 (hereinafter “Carenamed”).

These general conditions of sale (hereinafter “General Conditions”) are governed, where applicable, by the Consumer Code (D. Lgs. n. 206/2005), Section II, Remote Contracts (Articles 50 – 67) and the rules on electronic commerce (D. Lgs. n. 70/2003) and apply exclusively to the sale of products via Internet, as identified and listed in the “Shop” section of the Site.  The Customer is invited to print or store these General Conditions as preferred. In the event of changes to the General Conditions, the General Conditions published on the Site at the time the Customer sends the order will be applied to the purchase order.

Products and their prices presented on the Site represent an offer to the public in accordance with the terms specified in the General Conditions and on the Site itself. The conditions of this offer apply exclusively to purchases made through the Site.

Purchase contracts are concluded with Carenamed.

All the prices are shown within the section “Shop” are net of taxes, with clear evidence of the VAT excluded to be added. The price inclusive of VAT can be displayed in the “cart” section once the product has been selected and during the checkout phase of the order.

Delivery costs are charged to the Customer and adequately highlighted in the purchase order. The price highlighted at the time of the order is applied to the products, without any consideration of previous offers or any price changes that may have occurred subsequently. If the ordered products were to be delivered outside of Italy, the Customer could be subject to import duties and taxes. Any import duties or taxes must be paid when the order reaches the destination country. All additional taxes related to the customs clearance of orders are under the Customer responsibility.

Purchase orders must be made online through a specific procedure on the Site, by completing the registration form with required data needed to make the purchase.

The purchase contract will be considered in force when Carenamed will acknowledge receipt of the order by sending a confirmation e-mail to the e-mail address communicated by the Customer. This confirmation will summarize products chosen, their prices (including delivery costs), address for delivery and order number. The Customer undertakes to verify whether data contained within the order confirmation are correct and to communicate all corrections needed to Carenamed within 24 (twenty-four) hours from its reception. Possible additional expenses caused by errors due to data not reported in time, will be borne by the Customer. The order number generated by the system shall be used by Customer in any communication with Carenamed.  It is possible that occasional non-availability of the products offered may occur. If products chosen by the Customer are not available, in whole or in part, Carenamed will notify the Customer.

Payment can be made online by credit card, PayPal, advance bank transfer and cash on delivery according to the procedures specified within the Site. Contextually to the communication of the order confirmation, the corresponding amount of the purchased products will be charged to the Customer.

 

a) Online credit card

Credit cards accepted by PayPal are:

Whole data are transferred in encrypted form by SSL certificate, therefore they cannot be intercepted by external parties. In addition, data entry takes place directly on PayPal website connected with the card providers, thus ensuring maximum security.

 

b) Online debit card

Debit cards are always accepted through PayPal and all data are transferred in encrypted form by SSL certificate, therefore they cannot be intercepted by external parties. In both cases a) and b), once the payment with PayPal is completed, the buyer will be redirected to PayPal website, where he can access his account by entering the personal e-mail address and password. After registration it is possible to proceed with payments via PayPal without having to re-enter any data, even for subsequent purchases. By choosing to pay with PayPal the amount is charged directly to the credit card (Visa, Visa Electron, Mastercard) or prepaid (PostePay) assigned. PayPal protects the information of the buyer because no financial information is transferred.

 

d) Advance bank transfer

The buyer can make the payment by bank transfer addressed to Carenamed srls – UNICREDIT: IBAN IT50 Y 02008 69201 000105164556. Once the amount paid will be registered in Carenamed bank account, goods will be sent to the Customer.

 

e) Cash on delivery

The buyer can pay by cash on delivery. In this case, the purchase order will be applied an additional cost of 4,50 € + VAT, which will be reported in the order confirmation and then charged in the receipt / invoice.

All purchases made on the Site will be invoiced by Carenamed, which will issue a receipt/invoice for the purchased products by attaching a printed copy to the shipment and sending it electronically according to the terms provided by art. 1 d.lgs. 127/2015. For the issuance of the receipt/invoice, the information provided by the Customer will be used. No data change will be possible after the issuance of the receipt/invoice itself.

Carenamed will make delivery by specialized carriers only within the areas specified on the Site.

At the time of delivery, the presence of the Customer or a trusted person is required in order to check that the packaging is intact and clean and that the Products received correspond to what is indicated in the order. In case of visible defects, such as wrong quantity and/or wrong product and non-integrity of the packages, the Customer or his trusted person will have to take care of the relative report by contacting Carenamed within and not later than 24 hours from the delivery. Once signed the document of the courier, the Customer will not be able to oppose any dispute about the external characteristics of what has been delivered. Even in the presence of intact packaging, the goods must be checked within 24 hours of receipt. Possible hidden anomalies will have to be reported by e-mail. Any report beyond these terms will not be taken into account. For each statement, the Customer assumes full responsibility for what was stated.

Carenamed delivers the purchased products to the address indicated by the Customer, in the following way: at the time of placing the order will be indicated the estimated date of Delivery – 5/7 days for Italy (excluding islands) and 8/10 days for other states. This date has only an indicative value, therefore no responsibility can be attributed to Carenamed in case of non-respect of it. Delivery will take place without prior announcement and is intended at street level and will be made by authorized courier at a time between 8.00 and 18.00 from Monday to Friday. In case the shipment cannot be delivered to the first attempt will be made a new attempt at delivery. If the material in storage at the warehouses of the courier is not collected within 5 working days due to repeated inability to deliver to the address indicated by the Customer when ordering, the order will be returned to the warehouses of Carenamed. Arrangements will be taken for the new evasion and the related additional shipping costs.

Pursuant to art. 4 paragraph 1 of Legislative Decree 185/99, concerning the protection of consumers in respect of remote contracts, the Customer has the right to withdraw from the purchase within fourteen (14) working days from receipt of goods, upon transmission of written notice by email (the date of receipt will be considered). Once received acceptance by Carenamed, the Customer is required to return the goods at its own expense, undamaged and unused to: Carenamed srls – Viale della Concordia 1 by Colma srl warehouse – 62029 Tolentino MC – Italy. Packages will not be accepted with cash on delivery or freight collect.

If the goods have been damaged even in the packaging or opened/used before the return, the right of withdrawal will fall pursuant to art. 59 of the Consumer Code and therefore the returned goods will not be refunded.

It is specified that the prescriptions of this article are applicable to all cases in which the purchaser is not included under the category of Professional or Company, therefore holding a VAT number. In this last case, the recess can be requested and applied in the modalities described above until the date of shipment of the ordered goods, unless otherwise agreed with Carenamed.

Customer data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the information provided within the “Privacy policy” section of the Site.

These General Conditions are governed by Italian law, without giving rise to any principle of conflict of law. The Customer declares and accepts that for any legal action and/or dispute arising or deriving from the application of the Conditions, the sole competent court shall be the Court of Macerata (Italy).
